In 2023, the USDA published the Strengthening Organic Enforcement rule, which is set to come into effect in March 2024. According to this rule, all organic product transactions must apply for a transaction certificate from a certification body, and exports to the US must use a dedicated transaction certificate. The USDA has upgraded the Organic Integrity Database, through which dedicated transaction certificates for exports to the US can be issued. - After March 2024, all organic products exported to the USA must have a US-specific import certificate for customs clearance of the goods;
- Sales certificate for export to the US specifically. Once issued, no information can be modified. A replacement sales certificate for export to the US must be reapplied for.
- After March 2024, exporters, producers, and importers must all be certified, otherwise the corresponding enterprise/organisation name cannot be entered into the system;
- Organic goods exported to the US should have their sales certificate application materials submitted prior to departure for review by the certification body, but currently there is no requirement for a sales certificate to be issued prior to departure;
- Products that have obtained FOFCC Canada Organic certification and are exported to the US under the US-Canada Equivalency Arrangement must also use the US Organic Integrity Database to issue dedicated import certificates for export to the US.
- The outer packaging, bill of lading, and pro forma invoice of organic products exported to the United States must bear the organic label, namely the word “organic” marked before the product name. US Customs will inspect the goods during customs clearance.
