Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on Agricultural Product Quality and Safety, with a view to strengthening the management of agricultural product production sites, improving production site conditions, and ensuring production site safety.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 2 For the purposes of these Measures, agricultural product origins refer to the relevant areas where plants, animals, microorganisms and their products are produced.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
For the purposes of these Measures, safety of agricultural product production sites means that the environmental quality of the soil, water bodies, and atmosphere in agricultural product production sites complies with the requirements for producing safe agricultural products.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 3. The Ministry of Agriculture shall be responsible for the supervision and administration of the safety of agricultural product production sites nationwide.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
The agricultural administrative authorities of local people's governments at or above the county level shall be responsible for the demarcation and supervision and management of agricultural product production areas within their respective administrative regions.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Chapter 2 Origin Monitoring and Evaluation文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 4 The agricultural administrative authorities of local people's governments at or above the county level shall establish and improve the monitoring and management system for the safety of agricultural product production areas, strengthen the investigation, monitoring and evaluation of the safety of agricultural product production areas, compile annual reports on the safety status and development trends of agricultural product production areas, and submit them to the agricultural administrative authorities at the higher level for the record.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 5. The agricultural administrative departments of the people's governments at or above the provincial level shall establish national and provincial monitoring points respectively in the following areas to monitor dynamic changes in the safety of agricultural product production areas, and to guide the safety management and protection work of agricultural product production areas.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
(1) Agricultural product production areas surrounding industrial and mining enterprises;文章源自FOFCC-http://www.fofcc.org.cn/en/11226/

Article 6 Investigation, monitoring and evaluation of the safety of agricultural product production sites shall be carried out in accordance with relevant national standards and other technical specifications.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
The establishment, modification, and cancellation of monitoring points shall be subject to expert evaluation.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 7 Agricultural administrative departments of people's governments at or above the county level shall strengthen the statistical work of agricultural product place of origin safety information, and improve monitoring records for agricultural product place of origin safety.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/

Chapter 3: Demarcation and Adjustment of Prohibited Production Areas文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 8 Where toxic and hazardous substances in the place of origin of agricultural products fail to meet the safety standards for places of origin, resulting in the toxic and hazardous substances in agricultural products failing to meet the quality and safety standards for agricultural products, such a place shall be demarcated as a prohibited production area for agricultural products.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Non-edible agricultural products may be produced in areas where the production of edible agricultural products is prohibited.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 9 Where the circumstances specified in Article 8 of these Measures apply, the competent department of agriculture of the local people's government at or above the county level shall put forward a proposal for the delineation of prohibited production areas and submit it to the competent department of agriculture at the provincial level. (1) The results of producing area safety monitoring and agricultural product testing;文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
(2) Origin safety monitoring and evaluation report, including analysis of the causes of origin pollution, analysis of the correlation between origin and agricultural product pollution, evaluation methods and conclusions, etc.;文章源自FOFCC-http://www.fofcc.org.cn/en/11226/

Article 10 After a prohibited production area has been delineated, the nature of cultivated land and basic farmland shall not be changed, and the compensation standards for the requisition of agricultural land shall not be lowered.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 11 The agricultural administrative department of the county-level people's government shall erect signboards in the prohibited production areas, stating the location, boundaries, area, types of agricultural products prohibited from production, types of main pollutants, approving authority, date of erection, and other details of the prohibited production area.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/

Article 12 Where the safety conditions in a prohibited production zone have improved and comply with relevant standards, the competent agricultural administrative department of the local people's government at or above the county level shall timely put forward proposals for adjustment.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
The adjustment of prohibited production zones shall be carried out in accordance with the provisions of Article 9 of these Measures. Article 13 Local people's governments at or above the county level in charge of agricultural administration shall promptly report the results of the designation and adjustment of prohibited production areas for agricultural products within their administrative regions level by level to the Ministry of Agriculture for the record.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/

Article 14. The agricultural administrative departments of the people's governments at or above the county level shall promote cleaner production technologies and methods, and develop ecological agriculture.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 15. The agricultural administrative authorities of local people's governments at or above the county level shall formulate plans for the prevention, control and protection of agricultural product producing areas, and incorporate them into local agricultural and rural economic development plans.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 16. The agricultural administrative departments of people's governments at or above the county level shall take biological, chemical, engineering and other measures to remediate and treat prohibited agricultural product production areas and other agricultural product production areas where toxic and harmful substances do not meet the safety standards for places of origin.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 17: Agriculture administrative authorities of people's governments at or above the county level shall take measures to strengthen scientific research, technology promotion, publicity and training regarding the remediation and treatment of place of origin pollution.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 18: The environmental impact assessment documents for agricultural construction projects shall, following review in accordance with the law by the administrative department for agriculture of the local people's government at or above the county level, be submitted to the relevant departments for examination and approval.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Where existing enterprises or projects pollute agricultural product producing areas, the agriculture administrative department of the local people's government shall report to the people's government at the same level to take measures to reduce or eliminate the pollution hazards.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 19: No organisation or individual shall produce, catch or gather prohibited edible agricultural products or establish agricultural product production bases in prohibited production zones.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 20: Any organisation or individual is prohibited from discharging or dumping waste gas, waste water, solid waste or other toxic and harmful substances into agricultural product production sites.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
It is prohibited to pile, store, or dispose of industrial solid waste in agricultural product production areas. Where industrial solid waste is piled, stored, or disposed of around agricultural product production areas, effective measures shall be taken to prevent hazards to the safety of the agricultural product production areas.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 21 Any unit or individual that provides or uses agricultural water, as well as solid waste such as urban refuse and sludge used as fertilizer, shall undergo harmless treatment and comply with relevant national standards.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 22 Agricultural product producers shall make rational use of agricultural inputs such as fertilisers, pesticides, veterinary drugs, feeds and feed additives, and agricultural plastic films. Agricultural product producers shall promptly remove and recycle agricultural plastic films, agricultural input packaging, and other materials to prevent the pollution of agricultural product production environments.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/

Article 23: The agriculture administrative authorities of local people's governments at or above the county level shall be responsible for the supervision and inspection of the safety of agricultural product production sites.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
When carrying out supervision and inspection duties, agricultural administrative law enforcement officers shall present their administrative law enforcement credentials to the inspected unit or individual. Article 24: Where the agricultural administrative department of a local people's government at or above county level finds that an agricultural product production site is threatened by pollution, it shall order the polluting unit or individual to take measures to reduce or eliminate the pollution threat. Where a pollution accident occurs in an agricultural product production area, the agricultural administrative department of the local people's government at or above the county level shall investigate and handle it in accordance with the law.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
In the event of a sudden agricultural environmental pollution incident, it shall be handled in accordance with the provisions of the emergency response plan for sudden agricultural environmental pollution incidents.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Article 25 Funds for the safety monitoring, supervision, and inspection of places of origin shall be incorporated into the annual budget of the agricultural administrative department of the people's government at the corresponding level. Article 26. Prohibited production areas demarcated in violation of the demarcation standards and procedures stipulated in the Quality and Safety Law of Agricultural Products of the People's Republic of China and these Measures shall be invalid.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
Anyone who, in violation of the provisions of these Measures, unauthorisedly moves or damages the warning signs of a prohibited production zone shall be ordered by the competent department of agriculture of the local people's government at or above the county level to rectify the situation within a prescribed time limit, and may be subject to a fine of up to one thousand yuan.文章源自FOFCC-http://www.fofcc.org.cn/en/11226/
