Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on Agricultural Product Quality Safety, with a view to regulating agricultural product production and operation activities, strengthening the management of agricultural product packaging and labeling, establishing and improving the agricultural product traceability system, and ensuring agricultural product quality and safety.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/

Article 3. The Ministry of Agriculture shall be responsible for the supervision and administration of agricultural product packaging and labelling nationwide.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Local people's governments at or above county level shall be responsible for the supervision and administration of agricultural product packaging and labelling within their respective administrative areas.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 4 The State shall support scientific research on agricultural product packaging and labelling, promote scientific packaging methods, and popularise advanced labelling technologies.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 5 The agricultural administrative departments of people's governments at or above the county level shall include the funding for the management of agricultural product packaging and labelling in their annual budgets.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 6 The agricultural administrative departments of people's governments at or above the county level shall commend and reward units and individuals that have made outstanding contributions to the packaging and labelling of agricultural products.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Chapter 2 Agricultural Product Packaging文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 7 Agricultural product production enterprises, farmers' professional cooperative economic organisations, and units or individuals engaged in the purchase of agricultural products must package the following agricultural products intended for sale:文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(1) Agricultural products certified as pollution-free agricultural products, green food, organic agricultural products, etc., excluding fresh livestock, poultry, and aquatic products.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(2) Other agricultural products requiring packaged sales as stipulated by the administrative authorities for agriculture of the people's governments at or above the provincial level.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Agricultural products in compliant packaging that are unpacked and sold directly to consumers do not need to be repackaged.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 8 Agricultural product packaging shall meet the requirements for the storage, transportation, sale and safety assurance of agricultural products, and be convenient for dismantling and handling.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 9: Materials used for packaging agricultural products, as well as substances such as preserving agents, preservatives, and additives used, must comply with the requirements of national mandatory technical specifications.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/

Article 10 Agricultural products packaged and sold by agricultural product production enterprises, farmers' specialised economic organisations, and entities or individuals engaged in the purchase of agricultural products shall have their product name, place of origin, name of producer or seller, and date of production indicated or attached on the packaging materials by means of labels or other markings.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Where there are grading standards or additives are used, the product quality grade or the names of the additives shall also be indicated.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Unpackaged agricultural products shall indicate the product name, place of origin, name of the producer or seller, and other information by means of attached labels, signboards, identification tapes, or instructions.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 11 The text used in agricultural product labelling shall be standard Chinese. The content indicated on the label shall be accurate, clear and prominent.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 12: Where agricultural products that have obtained the right to use quality marks such as pollution-free agricultural products, green foods, or organic agricultural products are sold, the corresponding marks and the issuing authority shall be indicated.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
The fraudulent use of quality certification marks for pollution-free agricultural products, green food, and organic agricultural products is prohibited.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 13. Livestock, poultry, and their products, as well as agricultural products that are agricultural genetically modified organisms, shall also be labelled in accordance with relevant provisions.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/

Article 14 Agricultural product production enterprises, farmers' professional cooperative economic organisations, and units or individuals engaged in the purchase of agricultural products shall be responsible for the packaging quality and labelling content of the agricultural products they sell.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 15. The administrative departments for agriculture of local people's governments at or above the county level shall, in accordance with the Law of the People's Republic of China on Agricultural Product Quality and Safety, conduct supervision and inspection regarding the packaging and labelling of agricultural products.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 16: Under any of the following circumstances, the agricultural administrative department of the people's government at or above the county level shall handle and penalise the matter in accordance with the provisions of Articles 48, 49, 51 and 52 of the Law of the People's Republic of China on Agricultural Product Quality Safety:文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(1) using agricultural product packaging materials that fail to comply with the requirements of mandatory technical specifications;文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(2) where preservatives, antiseptics, additives or other materials used in the packaging process of agricultural products fail to comply with the requirements of mandatory technical specifications;文章源自FOFCC-http://www.fofcc.org.cn/en/11225/

Chapter 5 Supplementary Provisions文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
Article 17: For the purposes of these Measures, the meanings of the following terms are:文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(1) Agricultural product packaging: refers to the boxing, cartoning, bagging, wrapping, binding, etc., of agricultural products.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(2) Preservative: refers to synthetic or natural substances used to maintain the fresh quality of agricultural produce, reduce distribution losses, and prolong storage time.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(3) Preservatives: refers to synthetic chemical substances or natural substances that prevent agricultural products from rotting and deteriorating.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(4) Additives: substances, whether artificially synthesised or natural, added to improve the quality, colour, aroma, flavour and processing performance of agricultural products.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
(5) Production date: for plant products, it refers to the harvest date; for livestock and poultry products, it refers to the slaughter or yield date; for aquatic products, it refers to the capture date; and for other products, it refers to the date of packaging or sale.文章源自FOFCC-http://www.fofcc.org.cn/en/11225/
